These Terms of Service (“Terms”) govern your use of the Bea AI mobile application (“App”) and any related services provided by TechArt26 LLC (“we,” “our,” or “us”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Who We Are

We act as the provider of the App and the controller of any personal data collected as described in our Privacy Policy.

2. Eligibility

You must be at least 17 years old (or the minimum legal age in your country) to use Bea AI. By using the App, you confirm that you meet this age requirement. We do not knowingly allow children under this age to access or use the App.

3. Account Registration and Responsibilities

Some features may require an account. You agree to:

• Provide accurate, complete, and current information;
• Maintain the confidentiality of your account credentials;
• Be responsible for all activity under your account;
• Notify us immediately of any unauthorized use.

You may not use another person's account without permission.

4. App Usage Rules

You agree not to:

• Use the App for unlawful or harmful purposes;
• Attempt to reverse engineer, copy, or interfere with the App's functionality;
• Upload content that infringes intellectual property rights or violates laws;
• Attempt to gain unauthorized access to our servers, data, or systems.

We reserve the right to suspend or terminate access for violations of these rules.

5. Intellectual Property

All intellectual property rights in the App, including software, text, graphics, images, logos, and AI models, are owned by TechArt26 LLC or our licensors. You may use the App only as permitted by these Terms. No license to copy, modify, or distribute our content is granted except as expressly provided.

6. User Content

You retain ownership of any photos, videos, or other content you upload (“User Content”). By uploading, you grant TechArt26 LLC a non-exclusive, worldwide, royalty-free licenseto use, store, process, and display your content solely to provide and improve the App's services. You are responsible for the legality and appropriateness of any User Content you submit.

7. AI-Generated Content

The App may generate images, previews, or other content using AI. You acknowledge that:

• Generated content is provided for personal, non-commercial use unless otherwise agreed;
• We do not guarantee accuracy or suitability of AI-generated content;
• You are responsible for how you use or share AI-generated content.

8. Fees and Payments

The App may offer paid features or subscriptions. By purchasing, you agree to:

• Pay all applicable fees and taxes;
• Follow the billing and cancellation terms provided in the App;
• Understand that all fees are non-refundable unless otherwise stated.

9. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms or if we discontinue the service. Upon termination, your rights to use the App immediately end, and any unpaid fees remain due.

10. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

• That the App will be error-free, uninterrupted, or secure;
• That AI-generated content will meet your expectations;
• Accuracy, reliability, or completeness of any information provided.

11. Limitation of Liability

To the maximum extent permitted by law, TechArt26 LLC and its affiliates are not liable for:

• Indirect, incidental, or consequential damages;
• Any loss of data, content, or profits;
• Any decisions or actions taken based on use of the App.

12. Indemnification

You agree to indemnify and hold harmless TechArt26 LLC, its officers, employees, and affiliates from any claims, losses, or damages arising from your violation of these Terms, misuse of the App, or infringement of third-party rights.

13. Third-Party Services

The App may integrate with third-party services (e.g., analytics, advertising, cloud storage). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party content or services.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or the App shall be resolved in the courts located in Laramie, WY.

15. Changes to Terms

We may update these Terms periodically. The “Effective Date” at the top reflects the latest version. Continued use of the App constitutes acceptance of any changes. Significant updates may be communicated via in-app notification or email.
