This Privacy Policy describes how TechArt26 LLC ("we", "our", or "us") collects, uses, and protects your personal data when you use the Bea AI mobile application ("App") or interact with us through our services, in accordance with applicable data protection laws including the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other relevant legislation.

By using the Bea AI App, you consent to the practices outlined in this policy.

2. What Data We Collect and Why

We collect and process the following categories of personal data:

• Photos and Videos: When you upload or take a photo for analysis, treatment previews, or progress tracking. These are processed to deliver core features such as visual simulations, AI scores, and before/after views.
• Facial Data (Non-Biometric): Used temporarily for AI feature detection and simulation, but not stored or linked to your identity. We do not create or store biometric templates.
• Device and Technical Data: This includes device type, OS version, IP address, language, country settings, crash logs, and usage patterns. This is used to ensure functionality, improve the app, and detect errors.
• Interaction Data: How you use the app—what features you tap, what you preview or analyze—helps us improve and customize your experience.
• Identifiers: Such as IDFA (Apple) or AAID (Android), which are used for app functionality, analytics, and—if you consent—for advertising purposes.
• Support Data: If you contact us, we collect your name, email, and message content to respond to your request.
• Marketing and Notification Preferences: If you consent to push notifications or emails, we store your communication preferences and device tokens.

3. Legal Basis for Processing

We process your data under one or more of the following legal grounds:

• Performance of a contract: To provide you with the core features of the app, including simulations and image editing.
• Your consent: For advertising, email communications, and notifications.
• Legitimate interest: To improve the app, ensure security, perform analytics, and detect misuse.
• Legal obligation: Where necessary to comply with applicable laws and requests from authorities.

4. How Long We Keep Your Data

• Uploaded photos are deleted automatically from our servers after processing, or within 7 days.
• Generated images are also deleted after 7 days.
• Support communications are kept only as long as needed for resolution and compliance.
• Analytics and usage data are retained for up to 2 years.
• Marketing and consent records are retained until you opt out or for up to 2 years after last use.

5. Your Rights

Depending on your location, you may have the following rights under GDPR, CCPA, or similar laws:

• Right to access your personal data
• Right to correct inaccurate information
• Right to delete your data ("right to be forgotten")
• Right to restrict or object to processing
• Right to withdraw consent at any time

6. Who We Share Data With

We do not sell your personal data. We only share data with:

• Service providers: For cloud storage, analytics, customer support, and push notifications.
• Advertising platforms: Only if you give us permission, we may share identifiers with platforms like Google AdMob and AppLovin to serve you relevant ads.
• Legal or government authorities: When required by law or in response to valid legal processes.
• Business partners or acquirers: In case of a merger, acquisition, or restructuring.

All partners are subject to strict confidentiality and security requirements.

7. International Transfers

We may transfer your data outside the European Economic Area (EEA), including to the United States. Such transfers are made with appropriate safeguards, such as Standard Contractual Clauses (SCCs) or adequacy decisions, as required by law.

8. Age Restrictions

Bea AI is intended for users aged 17 or older, depending on your country of residence. We do not knowingly collect data from anyone under the age of 17. If we learn that we have collected personal data from someone under this age threshold, we will delete it promptly.

9. Advertising and Tracking Preferences

If you consent, we may show personalized ads based on your interactions within the app. These may use identifiers like your device’s IDFA (iOS) or AAID (Android). You can opt out at any time by:

• Adjusting your device settings:
  • On iOS: Settings > Privacy > Tracking > Disable app tracking
  • On Android: Settings > Google > Ads > Opt out of Ads Personalization
• Withdrawing consent inside the Bea AI app under Privacy Settings

10. Security Measures

We use technical and organizational safeguards to protect your data. These include encryption, secure servers, access controls, and automatic deletion of sensitive media. While we take steps to secure your data, no system can be guaranteed 100% secure.

11. Changes to This Policy

We may update this policy to reflect changes in legal requirements or app features. When we do, we will update the "Last Updated" date and may notify you in-app or via email if the changes are significant.
